Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: At the Seafood City Supermarket, the employer did not ensure that the portable step ladders being used in the stock room were inspected and in a serviceable condition in accordance with ANSI A14.5-2000: a) Stock room employees were using 4 portable step ladders (two 8 foot ladders, one 10 foot ladder, one 12 foot ladder) that were damaged. The employees were using the ladders to access store room stock shelves. b) The ladders were not periodically inspected and damaged ladders were not removed from service (ANSI A14.5-2000; 9.4.1 inspection and ANSI A14.5-2000; 9.4.2 damaged ladders). One feasible means of abatement would be to follow the requirements of the ANSI A14.5-2000 and implement a periodic inspection of the ladders and remove damaged ladders from service.
