Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer failed to ensure that the storage capacity for storage racks was not exceed, as follows: a.At the warehouse, a storage rack was not used in accordance with specifications as per Seismic Material Handling Engineering analysis. Documents provided by the company who conducted the analysis indicated a maximum weight capacity of 2,500 lbs per shelf. The two pallets of bearings that were stored on shelf CFL 1C had total gross weight of 2,749 pounds, exceeding the total weight capacity rated for the shelf. Pallets of bearings have collapsed in the past due to possible overloading. Employees were exposed to possible serious injury in the event of a collapse. Reference: Seizmic Material Handling Engineering analysis document dated, 12/18/2008. One feasible means of abatement is to follow Seizmic Material Handling Engineering "Analysis Document".
