causing or likely to cause death or serious physical harm to his employees:
The employer failed to ensure a place of employment which was free from
recognized hazards
that were likely to cause death or serious physical harm to employees as
follows:
a.At 243 Lakeshore Drive, Boulder City, NV the employer used a 5-ton
Columbus
McKinnon Corporation Series 622 chain hoist to support a suspended work
deck
in a 60 foot deep shaft. The manufacturer does not authorize the use of
the hoist
to support personnel. Employees were working from the deck installing
rebar at
a height of approximately 20 feet from the bottom of the shaft. Employees
were
exposed to possible serious injury or death in the event of the failure of
the chain
hoist.
Reference: CM Series 622 Hand Operated Chain Hoist Operating, Maintenance
& Parts Manual Page 3 under Do's And Do Not's: "Do not use hoist to lift,
support or transport people."
One feasible means of abatement would be to only utilize properly
engineered suspended scaffold
systems.
