Nevada Revised Statute 618.375(1):  Duties of employers.  The employer
failed to furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to his employees:
The employer failed to provide a place of employment free from recognized
hazards, as follows:
a. In the warehouse (building #3000), located behind 2950 South Highland
Drive,
Suites E and F, Las Vegas, NV., 89109, a compressed air system was
installed
to provide air pressure from an air compressor to a stapler and an air
nozzle for
tasks conducted in the packaging of vertical blinds. Schedule 40 polyvinyl
chloride (PVC) pipe was attached (coupled with elbows and "T" fittings),
to the
inner warehouse perimeter wall and was fitted with hoses to two drops to
quick
connect outlets. The air compressor (Portable-Cable Corp, Model D20159),
could
provide a maximum pressure of 135 PSI, and a stapler (ISM Boxer Stapling
Machine, Model AB150TC58CT-15MM), required 80-90 PSI to operate.
Employees were exposed to possible serious injuries or permanent
disability (such
as lacerations or impalement from plastic shrapnel), or death, from hazards
associated with the potential explosive rupture of polyvinyl chloride
(PVC) pipe,
while used to channel compressed air.
REF: The hazards involved with the use of polyvinyl chloride pipe for the
flow
of compressed air have been addressed in the OSHA Hazard Information
Bulletin,
dated May 20, 1988.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to encase the polyvinyl chloride (PVC) pipe in conduit or
shatter-
resistant material or replace with metal (copper or steel) pipe. (REF: The
Plastic
Piping Institute Recommendation B - Thermoplastic piping for the transport
of
compressed air or compressed gases.)
