Nevada Revised Statute 618.375(1):  Every employer did not furnish
employment and a place
of employment which was free from recognized hazards that were causing or
were likely to
cause death or serious physical harm to his employees:
The employer did not ensure that safe practices were adequate at the place
of
employment, as follows:
a)On January 7, 2010, an employee was using a Caterpillar 416 loader
improperly. The employee, who was the superintendent at the jobsite, had
another employee raise him up approximately 8 to 10 feet in order to
remove fruit from the palm trees. The employee was exposed to a fall
hazard.
Caterpillar SEBU6338-01, November 1990 Operation and Maintenance Manual
states the following:
Page 9, "Make sure no one is working on, underneath or close to the
machine before starting the engine or beginning to mover the machine.
Make sure the area is free of personnel."
Page 10, " Clear all personnel from the machine and the area. Make sure
personnel are not in reach of backhoe or in the path of loader."
One feasible method of abatement is to follow the Caterpillar Operation and
Maintenance manual.
