Nevada Revised Statute 618.375(1): Every employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The employer failed to furnish employment and a place which was free from recognized hazards as follows: a.During the inspection at the Paradise Place construction site, an employee used an all terrain forklift (Care Lift Zoom Boom 10056; model #ZB10056-44; serial #B10056T215570A) to elevate another employee to an upper work platform located on the second floor of the house being constructed. The employee that was elevated by standing on the forks of the all terrain forklift while it was being raised and extended. The operators manual for the Care Lift Zoom Boom 10056 state "Never ride or stand on forks". The operators manual also state: Platforms for elevating personnel shall conform to the guidelines set out in ASME B56.6b- 1998, Safety Standards for Rough Terrain Forklift Trucks. There was not a platform available for elevating personnel on the forklift on the site. A feasible mean of abatement would be to ensure that all employees operating powered industrial trucks have been properly trained on the operation and safe use of the power industrial trucks on the job site and ensure that employees use an approved method to access the upper floor work areas such as ladders.
