Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer did not ensure that a place of employment, free from recognized hazards, was furnished to employees as follows: a.Located at the Heritage Square South community, Employee #1 was observed by the Compliance Safety and Health Officer (CSHO) to be trimming a tree from the top rung of a six foot, Werner ladder, five feet above the ground at the time of the inspection. The employer had not trained the employee in the proper use and care of ladder prior to using it. Manufacturer's instructions prohibits using the top step of the ladder and ANSI Z133.1-2006 requires that all ladders be used in accordance to the manufacturer's recommendations. Reference: American National Standard for Arboricultural Operations-Safety Requirements, Z133.1-2006. 7 Hand Tools and Ladders 7.5 Ladders 7.5.9 All ladders shall be used in accordance to the manufacturer's recommendations and shall not be altered in a way that contradicts those recommendations. ABATEMENT: One feasible means of abatement would be to train all employees engaged in using ladders, safety procedures and instructions recommended by the manufacturer that pertain to each ladder they will be using while on the job.
