Nevada Revised Statute 618.375(1):  Duties of employers.  The employer
failed to furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to his employees:
The employer did not ensure that employees were provided a place of
employment which was
free from recognized hazards that could cause or likely cause death or
serious injuries as
follows:
a.Located at Reed Whipple Cultural Center, safe practices in the use of
ladders
were not practiced as required by manufacturer instructions and ANSI A14.5-
2000, when employees used a 12 foot, Werner ladder that they would place on
a flatbed roller with wheels to change out theater lighting plots or to
change bulbs
above the stage under the direction of supervisors. The practice exposed
employees to a possible 10 foot fall if the wheels were to roll causing the
employee to slip or fall from the ladder.
ABATEMENT: A reasonable means of abatement would be to use ladder per
manufacturer instructions and ANSI A14.5 which requires users to use safe
practices in the use of ladder equipment for maximum safety.
b.Located at Reed Whipple Cultural Center, employees were using a 12 foot
Werner ladder that was set on top of a flatbed roller to gain access to
the theater
lighting to create plots or to change bulbs above the stage under the
direction of
supervisors. None of the employees interviewed had been trained in ladder
safety
as required by ANSI A14.5-2000 and the employer's Safety Policy Procedure,
Subject: Ladders and Stairways, and were exposed to a ten foot fall if the
ladder became unstable due to improper use.
ABATEMENT:  A reasonable means of abatement would be to train employees
on the hazards and proper use of ladders as required by ANSI A14.5-2000 and
the employer's Safety Policy Procedure, Subject: Ladders and Stairway.

harm to his employees as
follows:
a.Located at Reed Whipple Cultural Center, a Ballymore elevating work
platform
was used by employees who had not been trained as required by the
employer's
Safety Loss Control Manual policies and ANSI 92.3-1990, Section 6;
Responsibilities of Owners, 6.9 Operating Training; "An owner who directs
or authorizes an individual to operate an aerial platform shall ensure the
individual has been trained in accordance with the manufacturer's operating
manual, and requirements listed in Section 8 of his standard before
operating the
aerial platform."
ABATEMENT: A reasonable means of abatement would be to train employees
who utilize the aerial lift as required by the employer's Safety Loss
Control
Manual and Section 8 of ANSI 92.3-1990.
