Nevada Revised Statute 618.375(1): Every employer shall: Furnish
employment and a place of
employment which are free from recognized hazards that are causing or are
likely to cause death
or serious physical harm to his or her employees.
The employer did not protect employees as follows:
a.On April 30, 2010 at the Fantastic Indoor Swap Meet, an employee was
injured
while operating the lift on the back of a delivery truck. This was the
first day that
the employee had operated this truck and he had not been instructed or
read the
operator manual as required by the manufacturer of the Maxon RCW-3B lift.
The
employee had lowered the lift part of the way down but forgot to unhook the
platform hold chain. The employee forced the platform hold chain off while
the
lift was partly lowered which caused it fall down, catching the employee's
hand
in-between the chain that holds the lift and the lift itself. The
Operation Manual
requires that the chain must be removed before lowering the platform. If
the
manufacturer's procedure had been followed the accident could have been
prevented. The employee suffered broken bones and tissue damage to his
right
hand.
Reference - Maxon Operation Manual, Page 6: 1. Using main toggle control
switch located on
curb side of lift column, raise unit till platform runners hit column
stops. Remove platform hold
chain and move slide bar towards front of truck, far enough to clear stop
block when unit is
lowering.
