Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer failed to provide a place of employment which was free from recognized hazards as follows: a.In the warehouse located at 2548 West Desert Inn Road there are 8 warehouse doors that designed to operate with electric motors. Of the 8 doors, only 2 are operational. For the remaining 6 doors, the employer directs employees to use a forklift to raise and lower the doors. According to Lawrence Doors, who is familiar with the listed doors, the motors that are installed on these doors do not have brake solenoids and the only way a forklift would be able to open the door would be to disassemble the drive chain or the motor gear box would need to be stripped. In addition, each door weighs between 2,500 and 2,800 pounds each. In either case there would be nothing to prevent the doors from falling to the ground, which could cause death or serious injury to any employee who access the roll up doors while they are open. A feasible means of abatement would be to either repair or replace the roll up doors with manufacturer approved equipment.
