Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer failed to ensure their portable reinforced plastic ladder extended approximately three feet above the point of support at the roof line, as follows: a.At the Green Valley Country Club Apartments, maintenance workers were exposed to fall hazards while climbing the employer's only portable reinforced plastic ladder to service HVAC (Heating, Ventilation, Air Conditioning) units located on the roof of apartment buildings 4, 12, and 21. The fixed ladders attached to these units were missing bolts that secured them to the side of the apartment building. Therefore the employer instructed its maintenance workers to set up an extension ladder at the landing of the second floor to access the roof. The ladder the workers were using did not extend approximately three feet above the point of support at the roof line as is required. Reference: ANSI (American National Standards Institute) A14.5 - 2000 9.3.10 Access To or From Upper Levels. When single section or extension ladders are used to get on or off at upper levels, the top of the ladder shall extend approximately three feet above the point of support at eaves, gutter or roof line. The ladder should be tied down to prevent slipping before the user ascends onto the roof. The user shall take care when ascending from the ladder to the roof or descending from the roof to the ladder in order to avoid tipping the ladder over sideways or causing the ladder base to slide. One feasible means of abatement would be to provide a refresher course in ladder safety to all maintenance employees and supervisors.
