Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that employee was exposed to fall and crushing hazards as he was riding the top back side of compactor when it was not equipped with a seat, seat belt and Rollover Protective Structure where he was positioned on the equipment: a) On or about 04/27/10 on Route 519, White Township NJ 07823 employee was exposed to fall and crushing hazards as he rode the top back side of a Ingersoll-Rand DD-110 asphalt compactor with no seat, seat belt and (ROPS) Rollover Protective Structure where he was positioned on the equipment. ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD, AMONG OTHER MEANS, WOULD BE FOR THE COMPANY TO ENFORCE THEIR EXISTING SAFETY AND HEALTH PROGRAM AS WELL AS THAT OF THE MANUFACTURES FOR THE SAFE OPERATING AND HANDLING OF THIS TYPE OF EQUIPMENT WHICH STATES "DO NOT ALLOW RIDERS ON THE MACHINE UNLESS IT IS EQUIPPED WITH AN ADDITIONAL SEAT, SEAT BELT AND A (ROPS) ROLLOVER PROTECTIVE STRUCTURE.
