Section 5(a)(1): of the Occupational Safety and Health Act of 1970. The employer did furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees that were exposed to fall hazards. a) On or about 06/23/10 at 2-28 Daily Court, Old Bridge, NJ 08857: Employees installing windows at heights of approximately 25' above ground level from a job- made platform that was resting on the forks on a Sky-Trak 8042 Rough Terrain Forklift. The basket/platform was: 1) not approved. 2) missing guardrail system/fall protection. 3) not secured to the forks of the Sky Trak 8042. 4) employee left elevated while Sky Trak was unattended. In addition, the employees working on the platform were not wearing a full body harness with shock absorbing lanyards. No fall protection was provided at heights of approximately 25' from ground level. ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD, AMONG OTHER MEANS, IS TO FOLLOW THE GUIDANCE SET FORTH IN THE LULL/SKY TRAK OPERATOR AND SAFETY MANUAL, WHICH PROHIBITS THE USE OF A NON-APPROVED HOME MADE WORK PLATFORM.VED
