Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: a)Rear of 434 Old Bridge Turnpike, South River,NJ:Employee was lifted in a bucket of a Komatsu Excavator, exposing the employee to a fall hazard. Violation occurred on or about 8/7/10. ABATEMENT NOTE:AMONG OTHER MEANS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD: Instruct employees that a bucket of an excavator should never be used to lift employees and to be used as a work platform.
