Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer
did not furnish employment and a place of employment which were free from recogn
ized hazards that were causing or likely to cause death or serious physical harm
to employees in that employees were exposed to the hazard of fire/explosion haz
ard: a/ New Jersey Hardwoods/Plainfield NJ Site - Plant/Production Areas: Dust C
ollection System/Equipment operating in Class II combustible (wood) dust locatio
ns: Employees exposed to the hazard of fire/explosion resulting from the potenti
al ignition of Class II combustible dust, in that, the dust collection system, m
achinery and/or equipment does not meet the requirements specified in NFPA 664.
At the time of this inspection the emplr. could not provide documented informati
on to confirm that the Dust Collection System/Cyclone has 1/ a spark detection s
ystem
2/ a fire suppression system 3/ that all components of the dust collection syste
m were of non-combustible materials, e.g., non-combustible flexible connectors/h
oses 4/ documentation/retention of records specific to the dust collection syste
m on inspections, testing, maintenance, service provider, etc. 5/ documentation/
retention of the training provided to employees/supervisors involved in the oper
ation, maintenance, equipment, etc. 6/ documentation/retention of records on the
dust collection system, e.g., manufacturer, safety manual, etc. Feasible abatem
ent method: Among other methods, one feasible and acceptable means of abatement
would be to comply with the guidelines outlined in the National Fire Protection
Association (NFPA) 664 Standard for the Prevention of Fires and Explosions in Wo
od Processing and Woodworking Facilities (2007 Edition.) Reference: National Fir
