Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to fall hazards:
a) On or about 11/19/10 at 35 Orion Road, Berkeley Heights, NJ 07922 two
employees were working on and from a jobmade platform resting (unsecured)
on the
forks of a Traverse Lift 8042, elevated in excess of 16 feet to the ground
below with
no fall protection systems in place. In addition the Lull was left running
and
unoccupied as the operator was also working on and from the jobmade
platform.
ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD,
AMONG OTHER MEANS, WOULD BE:
a) FOR THE COMPANY TO ENFORCE THEIR EXISTING SAFETY AND
HEALTH PROGRAM.
b) FOR THE COMPANY TO PROVIDE A PERSONNEL PLATFORM
APPROVED BY THE MANUFACTURER.
c) FOR THE COMPANY TO PROVIDE A FALL PROTECTION SYSTEM(S)
TO THE EMPLOYEE(s) WHILE WORKING ON AND FROM AN APPROVED
PLATFORM.
