Section 5(a)(1) of the Occupational Safety and health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from elevated surfaces. a) On or about 01/31/11 at 98 North Avenue East, Elizabeth, NJ 07201: Employee was elevated by a Yale Forklift Truck on a wooden pallet to the top of the 40' long trailer to heights of approximately 12'6". From the forklift elevated platform the employee walked on the roof of the trailer to remove snow. ABATEMENT NOTE: One feasible and acceptable abatement method, among others to correct this hazard, is to provide a "Safety Platform" properly secured to the lifting carriage and/or forks per ANSI B56.1-1975, Part III - Section 513, or equivalent protection.
