Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazard: a)Yard and Dock Area:Employer failed to enforce the wearing of seatbelts when there were tipping hazards during powered industrial equipment operations. Violation observed on or about 4/14/11. ABATEMENT NOTE:AMONG OTHER MEANS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD WOULD BE FOR THE COMPANY TO INSTRUCT AND ENFORCE THE USE OF SEATBELTS.
