Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from elevation: On and about January 11, 2010, and at times prior thereto, in the Metal Fabrication Building, located at 1700 S. School Ave., Fayetteville, Arkansas, employees were exposed to the hazard of falls from elevation in the following instances: (a)the employer did not provide a guarded walkway/platform for employees who were required to travel the length of the bridge during the performance of maintenance/inspection duties. This condition exposed employees to the hazards of falls from elevation ranging between 20 feet and 29 feet to the level below. (b)the employer did not provide a guarded walkway/platform for employees who were required to travel the length of the crane's rails to perform maintenance when the crane's trolley malfunctioned when it had traveled out above the yard. This condition exposed employees to the hazards of falls from elevation ranging between 20 feet and 29 feet to the level below. Among other feasible means of abatement, three acceptable methods of abatement include (1) provide a guarded walkway where employees can safely perform maintenance and repair duties; (2) access the bridge and rails with an aerial lift, (3) wear personal fall proper fitting personal fall protection with secure anchor point while performing servicing and/or maintenance. 0r In The Alternative 29 CFR 1910.23(c)(1): Open sided floor(s) or platform(s) 4 feet or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: On and about January 11, 2010, and at times prior thereto, in the Metal Fabrication Building, located at 1700 S. School Ave., Fayetteville, Arkansas, employees were exposed to the hazard of falls from elevation in the following instances: (a)the employer did not provide a guarded walkway/platform for employees who were required to travel the length of the bridge during the performance of maintenance/inspection duties.
