Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)At lot behind auditorium building: On or about February 9, 2010 and at times prior, the employer exposed employees to struck-by hazards, in that the missing hook latch was not in place to prevent suspended loads from slipping off the hook when employees operate the crane to land bundles of roofing panels on the roof of the building. Feasible abatement methods include, but are not limited to: install the hook latch; requiring employees to conduct and document pre-operation inspections to identify deficiencies; Have semi-annual and annual certifications of the crane by a qualified party.
