Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from vehicular traffic: Or in the alternative: 29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, or maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: a)In the roadway at the entrance to East Chase Galleria Mall: On 22 February 2010 and at times prior to, the employer failed to protect employees from struck-by hazards by requiring the use of high visibility reflective vest for employees working in and walking across the roadway. Among other methods, one feasible and acceptable method to correct this hazard is: Provide and require the use of high visibility, reflective vests or clothing for employee use while exposed to vehicular traffic.
