Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: ANSI /ASSE A10.31-2006, Paragraph 8.2.2: The inspection procedure for mobile units is divided into two classifications based upon the intervals at which inspections and tests shall be performed.The owner shall set intervals in accordance with the manufacturer's recommendations. Such intervals are dependent upon component function and exposure to wear and deterioration as well as other agents that adversely affect component life. Two classifications are designated. ANSI /ASSE A10.31-2006, Parrafo 8.2.2: El procedimiento de inspeccion para las unidades moviles se divide en dos clasificaciones basadas en los intervalos a los cuales las inspecciones y pruebas se realizaran. El propietario debera establecer intervalos de conformidad con las recomendaciones del manufacturero. The operator of the vehicle (6-6021: 1996 INTERNATIONAL TRUCK D-1000 1996 INTL D-1000 Grua Barrena 45) that was going to be used for the operation went down the equipment at that time the winch activated itself started collecting, the operator ran to the crane and climbed the ladder to reach the controls and then was hitted in the head with the hook of the crane. The employee was transported to the hospital where he died due to the injuries suffered at the accident. The employer did not assure that users and mechanics of the equipment inspected and maintained the equipment, following the recommendations of Manufacturer Manual, ANSI / ASSE A10.31-2006, paragraph 8.2.2 and the Manual of Electrical Distribution Safety Rules, Section III: Operation and maintenance of automotive equipment to ensure proper operation of equipment. In the evaluation performed by Mark Greer, Principal Electrical Engineer of Altec Industries found the following: 1)A portion of the center return spring was missing from this controller. Without a complete center return spring the controller did not automatically returns to the neutral center position. Rust and corrosion at the point of the break indicated that the center return spring has been broken for an extended period of time. 2)The control was without the standard knob and neutral interlock" neutral installed.3)Control panel in which the subject controller was installed showed significant voids in the area of the protective rubber boot. The controller boot protects the internal control of the pollution and moisture. The control showed a significant level of oxidation in the shaft and on the internal components, indicating a long- term direct exposure to the environment. 4)The controller remained displaced condition when released. Hazard: Equipment malfunction and provoke an accident Among other correction methods, a feasible and acceptable was inspect vehicles according to the manufacturer's recommendations to prevent vehicles with defects are used. En la Calle Esquilin, esquina Calle Castro Vinas en Santurce un grupo de empleados de la AEE se disponia reemplazar un poste de madera por uno de hormigon. El operador del vehiculo (6-6021: 1996 INTERNATIONAL TRUCK D-1000 1996 INTL D-1000 Grua Barrena 45) que se iba a utilizar para efectuar la operacion bajo, en ese momento el guinche de la grua se activo solo y comenzo a recoger, el operador corrio hacia la grua y subio por la escalera para llegar a los controles y en ese momento y fue golpeado en la cabeza por el gancho de la grua. El empleado fue transportado al hospital donde murio a causa de las lesiones sufridas en el accidente. El patrono no se aseguro que los usuarios y mecanicos del equipo inspeccionaran y mantuvieran el equipo, siguiendo las recomendaciones del Manual del Manufacturero, del ANSI/ASSE A10.31-2006 parrafo 8.2.2 y del Manual de Reglas de Seguridad Distribucion Electrica, en la Seccion III: Operacion y Conservacion de Equipo Automotriz, para asegurar la operacion apropiada del equipo. La bota del control protege el interior del mismo de contaminacion y humedad. El control presentaba un nivel significativo de oxidacion en el mango y en los components internos, indicando una prolongada exposicion a las condiciones ambientales. 4)El control permanecia desplazado cuando se liberaba. Riesgo: Malfuncionamiento del equipo y se provoque un accidente. Esta requiere la eliminacion de todas las cubiertas con el fin de realizar las operaciones necesarias de mantenimiento, operacion y lubricacion. Se deben de mantener registros permanentes, por escrito y con fecha de todas las operaciones de servicio en el equipo. Cuando se realiza Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The el mantenimiento de rutina y la inspeccion, el uso de una lista de cotejo como la que se muestra en el Manual del Manufacturero asegura que no se pasen por alto las areas criticas y facilita un documento ya preparado de registro de servicio permanente. En un periodo de tiempo el patrono no realizo el mantenimiento preventivo del vehiculo de acuerdo con las recomendaciones del fabricante y basado en las employer did not condiciones ambientales y la severidad de uso del mismo. En el pasado la AEE tenia una hoja de cotejo la cual utilizaban para las inspecciones de mantenimiento de los vehiculos y la misma se causando o que dejo de utilizar, sustituyendo esta por un registro de records en la computadora. Riesgo: Malfuncionamiento de equipo que puede ocasionar accidente. The operator of the vehicle (6-6021: 1996 INTERNATIONAL TRUCK D-1000 1996 INTL D-1000 Grua Barrena 45) that was to be used for the operation went down the equipment at that time the winch was activated itself and started collecting, the operator ran to the crane and climbed the ladder to reach the controls and then was hitted in the head with the hook of the crane. The employee was transported to the hospital where he died due to the injuries suffered at the accident. The employer did not perform maintenance to the vehicle following the recommendations of the Manufacturer Manual, ANSI / ASSE A10.31-2006, paragraph 8.4 and the Manual of Electrical Distribution Safety Rules, Section III: Operation and maintenance of automotive equipment to ensure proper operation of equipment. In the evaluation performed by Mark Greer, Principal Electrical Engineer of Altec Industries found the following defects: 1)A portion of the center returned spring was missing from this controller. Without a complete center returned spring the controller did not automatically returned to the neutral center position. Rust and corrosion at the point of the break indicate that the center return spring has been broken for an extended period of time. 2)The control was without the standard knob and neutral interlock" neutral installed. 3)Control panel in which the subject controller was installed show significant voids in the area of the protective rubber boot. The controller boot protects the internal control of the pollution and moisture. The control shows a significant level of oxidation in the shaft and on the internal components, indicating a long-term direct exposure to the environment. 4)The controller remaining displaced condition when released. According to manufacture's recommendations, a planned program of proper routine preventive maintenance and inspection is an important key to obtaining long life from any type of equipment and prevent accidents. The normal recommended maintenance schedule includes maintenance, inspection and lubrications operations at intervals of 83 hours of operations or 1 month, 250 hours of operations or 3 months and 1,000 hours of operations or 1 year. The specified actions should be performed at the specified number of elapsed operating hours or number of elapsed months, whichever comes first. The annual inspection includes the 3 month inspection and the 3 month inspection includes the 1 month inspection. Additional or more frequent maintenance may be required if the unit is operated under severe conditions. The 3 month inspection is very thorough. It requires the removal of all covers in order to perform the necessary maintenance, inspection and lubrication operations. Permanent, written, dated records should be kept of all service operations on the equipment. When performing routine maintenance and inspection, the use of a checklist such as the one shown in the Manufacturer's Manual ensures that critical areas are not overlooked and provides a ready-made document for the permanent service records. At a period of time the employer did not perform preventive maintenance of the vehicle following to the manufacturer's recommendations and based on environmental conditions and severity of use. Since 2006, this vehicle went to the garage for preventive maintenance on only four occasions and that was only for the car wash, oil, filters and fluids change, sometimes greasing, on other occasions went to the workshop for specific repair or something that was defective. In the past, the AEE had a checklist that was used for the maintenance inspections of vehicles and it was discontinued and replaced it with a computer registration log. Hazard: Equipment malfunction that can provoke accident. Among oter correction methods, a feasible and accept was perform the preventive maintenance to the equipment according to the manufacturer's recommendations. En la Calle Esquilin, esquina Calle Castro Vinas en Santurce un grupo de empleados de la AEE se disponia reemplazar un poste de madera por uno de hormigon. El operador del vehiculo (6-6021: 1996 INTERNATIONAL TRUCK D-1000 1996 INTL D-1000 Grua Barrena 45) que se iba a utilizar para efectuar la operacion bajo del mismo, en ese momento el guinche de la grua se activo solo y comenzo a recoger y el operador corrio hacia la grua y subio por la escalera para llegar a los controles, en ese momento fue golpeado en la cabeza por el gancho de la grua. El empleado fue transportado al hospitaldonde murio a causa de las lesiones sufridas en el accidente. El patrono no realizo el mantenimiento siguiendo las recomendaciones del Manual del Manufacturero, del ANSI/ASSE A10.31-2006 parrafo 8.4 y del Manual de Reglas de Seguridad Distribucion Electrica, en la Seccion III: Operacion y Conservacion de Equipo Automotriz, para asegurar la operacion apropiada del equipo. En la evaluacion realizada por Mark Greer, Ingeniero Electrico Principal, de Altec Industries se encontro los siguientes defectos: 1)Una porcion del "spring" de retorno central se habia desprendido del control. Sin esto en su lugar el control no retornaba automaticamente a su posicion neutral. El moho y la corrosion en el punto de rotura sugeria o daba indicios que el "spring" de retorno central habia estado roto por un extenso periodo de tiempo. 2)El control se encontraba sin el boton standard y el "interlock" neutral instalado. 3)Al area de las botas de gomas en los controles le faltaban pedazos. La bota del control protege el interior del mismo de contaminacion y humedad. El control presentaba un nivel significativo de oxidacion en el mango y en los components internos, indicando una prolongada exposicion a las condiciones ambientales. 4)El control permanecia desplazado cuando se liberaba. De acuerdo con las recomendaciones del manufacturero, un programa planificado de mantenimiento preventivo e inspeccion rutinario y adecuado es una clave importante para la obtencion de una larga vida util de cualquier tipo de equipo y para prevenir accidentes. El itinerario normal de mantenimiento recomendado incluye el mantenimiento, inspeccion y lubricacion a intervalos de 83 horas de operacion o 1 mes, 250 horas de operacion o 3 meses y 1,000 horas de operacion o 1 ano. La accion prevista se debe realizar en el numero especificado de horas de funcionamiento transcurrido o el numero de meses transcurridos, lo que ocurra primero.
