General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling struck-by hazards: Shop Building - Frequent and periodic inspections were not performed on the three-ton JET overhead hoist. Employees were exposed to struck-by hazards associated with falling loads and/or an overloaded hoist. Among other methods, one feasible and acceptable abatement method is: Perform frequent and periodic inspections as required by ASME B30.16-2007 - OVERHEAD HOISTS, Section 16-2.1.2 and 16-2.1.3. Inspections include, but are not limited to, controls and operating mechanisms for improper operations; safety devices for malfunctions; deterioration or leakage in air systems; and, deformations, chemical damage, or cracks in hooks. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is completed.
