Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to stuck-by hazards:
Employees working at the jobsite on South Andover Rd., between Harry and
Minneha,
Wichita, Kansas were exposed to struck-by hazards in that:
a)Flaggers were not performing traffic control tasks when they left the
roadway to
assist with trenching activities.
b)STOP/SLOW paddles (although available) or red flags were not utilized to
notify
passing vehicles to slow down or to stop.
Among other methods, one feasible and acceptable method to correct this
hazard is to
ensure that flagmen are in position and utilize red flags or STOP/SLOW
paddles
as
referenced in Chapter 6E., Flagger Control, in the Manual On Uniform
Traffic Control
Devices For Streets and Highways, U.S. Department of Transportation,
Federal Highway
Administration, 2009 Edition.
29 CFR 1903.19(c)(1) requires certification that the abatement of the
above violation is
completed.
