Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to struck-by and falling hazards:
On or about May 27, 2010, the employer did not require inspections of the
manually operated
hand crank for the end dump tarp.  Employer did not ensure that the wire
lock pin was properly
maintained.  Employees were exposed to hazards associated with the
unexpected separation of
the crank extension from the splined U-joint.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THIS HAZARD IS:  Inspect the wire lock pin every 2 to 4 weeks as
required by
the owners manual, pages 25 and 26.
29 CFR 1903.19(d)(1) requires certification and documentation that the
abatement of the
above violation is completed.
