Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
a place of employment which was free from recognized hazards that were
likely to cause death
or serious physical harm to employees in that employees were exposed to
vehicular struck-by
hazards while working in and near the traveled way without providing
advance warning to
approaching road users of utility work.
On March 12, 2010, William Charles Construction Company, LLC employees
worked in and
near the traveled way of south bound I-39 at mile post 97 without warning
approaching south
bound road users of utility maintenance work.  Among other method,
feasible and acceptable
abatement methods to correct this included, but are not limited to the
following:
1.Ensure that all employees working in and near motor traffic work sites
are trained
in the requirements of the Manual on Uniform Traffic Control Devices,
Millennium Edition regarding advance warning to approaching road users.
2.Ensure that a work rule is established that requires advance warning to
road users
of utility maintenance work that is performed in and near the roadway.
Abatement certification is required for this item in accordance with
requirements of 29
CFR 1903.(c).
