Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an amputation hazard. a) Brake Department - Employees were exposed to an amputation hazard while operating unguarded press brakes. As an alternative to guarding, the employer had not developed and implemented a safe distance program. On or about 03/25/2010. NOTE: One feasible abatement method would be to develop and implement a safe distance program that complies with the requirements of ANSI B11.3-1982 and OSHA Directive CPL 2-1.25. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
