Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees are exposed to thermal, electrical, struck by
and caught between
hazards associated with performing repetative maintenance task without
having developed a
standard procedure from which to perform that task and remove the
potential for an
employee to be injured.
The employer is failing to protect the employees from potential
electrical, thermal and caught
between hazards associated with repairing the sump pump in the basement of
the facility.
The most recent example of this was found in the basement of facility
located at 14401 S.
5th Street, Omaha, NE 68123 where the employer has employees repairing the
sump pump
without having developed any standard procedure where by the employer had
taken time to
assess the hazards associated with this task, identify the tools or
equipment required to
perform this task or trained any of the exposed employees on how to
implement these
procedures in order to reduce the potential for injury.
One or more feasible abatement methods:
(a)  The company shall develop a written procedure on replacing or
performing
maintenance on the sump pump where all foreseen hazards are identified,
any that
may be addressed by engineering controls corrected and all necessary PPE
needed be
identified to perform this task.
(b)  Train all exposed employees on the implementation of that written
procedure to
include the step by step process for removing the pump from the sump hole
and
replacing the pump back into service in the sump hole.  The employer shall
also
identify which types of actions that were previously accepted or have gone
uncorrected (steam as a method of heating the water and melting the
coagulated
grease) will not be used from this point forward.
(c)   Identify which employees will perform this work and thus require
training to
perform this task.
Abatement certification and abatement documentation is required for this
violation.  The
documentation should include written verification of abatement, applicable
measurements or
monitoring results, and photographs or videos which you believe will be
helpful. The
abatement certification sheet is enclosed with the citations.
