Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to struck-by and/or crushing
hazards from falling
loads:
a) In the Legging Area, employees were exposed to struck-by and/or
crushing hazards from
falling loads, such as fractured bones when loads (grain bins) fall
unexpectedly from an
overloaded hoist. The employer did not ensure that employees used hoists
to lift only loads
within the hoist's lifting capacity. A 3-ton underhung hoist was being
used to lift and
maneuver grain bins that weighed approximately 10,000 - 16,000 lbs, and
the bins have
unexpectedly fallen.
b) In the Shelling Area, employees were exposed to the same hazard as a
5-ton
hoist was
being used to lift and maneuver grain bins that weighed approximately
10,000 - 16,000 lbs
while employees work and walk under the suspended grain bin.
AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT
METHODS TO CORRECT THIS HAZARD ARE:
1.)Train employees to identify the hoist capacity and ensure hoists are
not used to lift
materials exceeding the identified capacity and also to remain clear of
suspended
loads.
2.)Develop work rules and disciplinary procedures prohibiting using hoists
to lift loads
that would exceed the hoist capacity and also prohibiting employees
working and
walking under or near suspended loads.
3.)Utilize and implement the guidelines as outlined in the American
Society of
Mechanical Engineers Overhead Hoists (Underhung). ASME B30.16-2007.  This
includes that the operator shall be familiar with all operating controls
of the hoist, and
be instructed in the operation(s) to be performed. This includes, but is
not limited to:
(a)Instructions shall include, as applicable, the warnings on the hoist,
the hoist use
practices listed in this Section, and the usage instructions portions of
the hoists'
manufacturer's manual;
(b)The operator shall not pick up a load in excess of the rated load
appearing on the
hoist or load block, except during properly authorized tests or properly
authorized
planned engineered lifts in accordance with para. 16-3.2.2;
(c)The operator shall not lift or lower a load with the hoist until the
operator and all
other personnel are clear of the load;
(d)Frequent inspections shall be performed at intervals defined in para.
16-2.1.1(b)(1)
and shall include observations during operation.
Abatement certification and abatement documentation is required for this
violation.

In the Legging Area, employees were exposed to fall hazards, resulting in
injures such as
fractured bones when fiberglass ladders that are being used fail. The
employer did not ensure
that employees did not use defective ladders. Employees were using a
Keller 8 foot ladder
that was defective. The ladder had a support brace on the back that was
damaged.
AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT
METHODS TO CORRECT THIS HAZARD ARE:
1.) Train employees to recognize conditions to prohibit using fiberglass
ladders
which
are defective.
2.) Develop work rules and disciplinary procedures prohibiting using
fiberglass
ladders which are defective.
3.) Utilize and implement the guidelines as outlined in the American
National
Standard for Ladders - Portable Reinforced Plastic - Safety Requirements
ANSI
A14.5 - 2000.  This includes that the user shall be familiar with all
usage of
fiberglass ladders. This includes, but is not limited to:
(a) Instructions shall include, as applicable, the warnings on the ladder,
the ladder use
practices listed in this Section, and the usage instructions portions of
the ladder
manufacturer's manual;
(b) The ladder shall be inspected periodically, preferably before use;
(c) Broken or bent ladders shall be taken out of service until they are
repaired by a
competent mechanic or destroyed in such a manner as to render them useless.
Abatement certification and abatement documentation is required for this
violation.  The
abatement certification sheet is enclosed with the citations.
