Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
In Area 5 of JBS USA, LLC on Head Table #1, Grand Island, NE: The employer
did not
furnish a place of employment which was free from a recognized hazard that
caused or was
likely to cause death or serious harm to employees in that employees were
exposed to the
hazard of being struck by a metal arm of a jawbone breaker on a Kent Head
Table BHT-1.
Specifically, on or about March 18, 2011, and at times prior to, an
employee was exposed to
a hazard of being struck by a metal bar from a jawbone breaker on a Kent
Head Table
Machine BHT-1. The welds on the arm were known to break from the force of
the arm
striking a back plate on the machine. In this instance the weld on the arm
broke and the arm
bar was thrown from the machine and struck an employee in the face
seriously injuring the
employee.
Among other methods, feasible and acceptable methods of abatement are:
1)Reducing the force of the machine by installing hydraulics with a buffer
thereby
reducing the amount of upward force on the arm
2)Redesign the machine
3)Upgrade to a new model head table
4)Installing guards to protect employees in the trajectory path of the arm.
Abatement certification and abatement documentation is required for this
violation. The
documentation should include written verification of abatement, applicable
measurements or
monitoring results, and photographs or videos which you believe will be
helpful. The
abatement certification sheet is enclosed with the citations.
