Section 5(a)(1) Of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards. East side of Scale Building - The employer is failing to ensure that modifications to the John Deere 2940 tractor were authorized by the manufacturer to ensure that the modification did not impair the function and/or safety of the machine's performance. The employer had manufactured forks in house that were installed along the bottom edge of the attached bucket. Among other methods, feasible and acceptable methods of abatement are: Acquire the owners manual for a 2940 John Deere Tractor. Follow owners manual for 2940 John Deere Tractor for any and all modifications/attachments. Utilize proper equipment for the tasks to be performed, for example utilize a powered industrial truck to move palletized items. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.
