Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to fall hazards ranging from four to twenty feet while operating and working from the elevated platform of a Crown stockpicker. Falling a distance of four to twenty feet to the concrete floor below is likely to result in serious injuries such as contusions and broken bones or death. Arrow Distributing Inc -- Throughout the warehouse: The employer failed to protect employees from fall hazards greater than 4 feet in height above the next lower level. Employees were allowed to stand on and work from the elevated platform of a vertical forklift without benefit of a restraint or appropriate fall protection device. Instances include, but are not limited to, employees picking orders while elevated on the Crown lift more than four feet above the ground, without the required use of a restraint device or harness. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: 1.Require the use of appropriate restraint methods such as a body belt and lanyard when on or working from an elevated platform. 2.Implement a disciplinary policy regarding the use of the stockpicker and the required use of appropriate fall protection/restraint devices. 3.Retrain employees with regard to fall protection and disciplinary policies. 4.Do not elevate employees; store materials at a level or in a manner that does not require employees to be elevated. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.
