Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The
employer does not
furnish employment and a place of employment which are free from
recognized hazards of being
struck-by vehicular traffic which are causing or likely to cause death or
physical harm to
employees:
This violation was recently observed on or about January 16, 2010, in the
trailer drop-off
lot where truck drivers accessing the rear of the trailer to secure the
load were exposed
to being struck by trailers being manuvered behind and beside their
trailer as they walked
to the rear of their trailer.
Pursuant to 29 C.F.R. 1903.19 within ten days of the date of this
citation, the employer
must submit the documentation describing the actions it is taking to
assure that it's truck
driver are trained on the plan that the company develops to assure the
safety of drivers
in drop-off/pick-up areas.
Among others, one feasible and acceptable method to correct the hazard is
the
development and implementation of the following :
1.A survey of workplaces where drivers drop-off/pick-up loads so as to
determine the
potential for vehicular accidents involving drivers when they leave their
vehicles and the
factors that would contribute to such accidents, including but not limited
to obstructed
operators vision, blind corners, restricted operational areas, and other
factors such as
poor lighting and visibility.
2.The development of a system that will define the procedures that
vehicles adhere to
when the operator is picking up a load or dropping off a load. Such system
must include
elements such as the following:
a. The restriction of where driver may walk when they dismount their
vehicle,
as
specified by Chapter 12 of the National Safety Council Accident Prevention
Handbook,
10th Edition.
b. The development of work rules  that establish work rules that ensure
that all drivers
are clear of any potential hazards (i.e.struck- by and or
caught-in-between) when they
leave their vehicle for operational purposes as specified by Chapter 12 of
the National
Safety Council Accident Prevention Handbook, 10th Edition.
3. The training of all employees in the provision of the program.
