P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck by vehicular traffic
while working in the
street:
a)Along Bryan Street between Drayton Street and Bull Street, on or about
May 20,
2010 and at times prior to, employees were exposed to being struck by
vehicular
traffic while in the street moving traffic control barrels and observing
the
movement of the aerial lift maneuvering around the building.
One feasible and acceptable means of abatement is to ensure that employees
who are exposed
to vehicular traffic wear visibility vests or other appropriate high
visibility clothing in accordance
with the MUTCD 2009 Edition, Section 6D.03.
ABATEMENT CERTIFICATION IS NOT REQUIRED.TION
