P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard(s) of crushing and struck-by in that
close proximity
below-the-hook lifting devices were not maintained in accordance with
ANSI/B30.20.
a)Throughout plant area, on or about August 18, 2010, and at time prior
to, the
employer did not ensure employees were trained on the safe operation and
use of
below the hook lifting devices such as, but not limited to Close Proximity
Lifting
Magnets in that they were not rated, tested or approved for their use,
which
exposed employees to crushing and struck-by hazards.
Among other methods, feasible and acceptable methods to correct each of
these hazards
are to:
1. Rate and mark the load capacity of all below-the-hook lifting devices
on a tag/plate
or equivalent in accordance with ASME B30.20.
2. Conduct frequent and periodic inspections of the lifting device in
accordance with
ASME B30.20.
