P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of getting thrown out of the operator's seat and being crushed by the industrial lift truck: a) On or about July 28, 2010, an employee was observed not wearing his seatbelt while operating a forklift TRAVERSE, model # 6035 as a result the operator was exposed to being thrown, ejected and crushed. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTED METHOD TO CORRECT THIS HAZARD IS: Assure that employees who operate forklifts wear seatbelts. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED.TION
