P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the struck-by hazard(s):
a) In the Twelve Oaks Shopping Plaza at the rear truck entrance, on or
about August
8, 2010, employees operated a concrete saw, a jack hammer, and removed
concrete debris, exposed to vehicular traffic and struck-by hazards.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard includes the employer implement and follow the information in the
ANSI / ISEA
107; 2004 edition class 2 and 3, Safety Standard for Reflective Vests by
providing and
requiring the use of high visibility clothing or vests in areas exposed to
vehicular traffic.
