P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazard(s): a)Scrap Yard - On or about February 18, 2011, employees were exposed to struck- by hazards when they worked around moving vehicles and heavy equipment while performing scrap yard operations.high visibility reflective vests were not worn to enable scrap yard operators to be visible to vehicular traffic. A feasible and acceptable means of abatement is to ensure all employees are provided with reflective vest and have been instructed to utilize reflective vest while working within the scrap yard where clients are delivering scrap metal in privately owned vehicles and employees are operating heavy equipment to process scrap metal. b).In the Scrap Yard, On or about February 23, 2011, employees were exposed to the struck-by hazards when they worked around the WA500 Komatsu Wheel Loader, which was operated without a functional audible backup alarm. A feasible and acceptable means of abatement is to: 1.Follow the Manufacturer's Operator's Manual by using only service parts meeting the manufacturer specifications. 2.Train operators and maintenance personnel to inspect equipment for defects and to complete service and repairs for equipment prior to being returned to service. ABATEMENT CERTIFICATION IS REQUIRED.TION
