P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to the hazard(s) of falling from or being struck by the bucket of skid- steer loader that was lifting the employee four feet above the ground: a)Along the east side of MLK Boulevard near 34th street, on or about March 25, 2011, a Bobcat S250 skid-steer loader was being used to elevate an employee who was standing in the bucket four feet above the ground while latching the end gate of a dump truck. ABATEMENT CERTIFICATION IS REQUIRED. One feasible and acceptable means of abatement is to provide an alternate means of access such as a ladder.
