P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard(s) of:
a) On or about April 7, 2011, at the worksite, an employee rode on the
load of a wood pallet
containing roofing materials of a HIAB 335 K-4 Hipro Truck Crane, in order
to gain access to
a two-story roof section of a house. The employee, riding on the load, was
exposed to a 16 foot
fall hazard and possible struck-by hazard from the crane boom.
ABATEMENT CERTIFICATION IS NOT REQUIRED
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
for the employer to provide a ladder as a method of gaining access or
egress to the roof or to
follow the American National Standard, ASME B30.23, which addresses the
requirements
when
lifting personnel.
