P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of: a) At the South exterior elevation of the 1809 Frederica Rd. St Simons Island GA construction site on or about June 9, 2011, an employee not wearing the seatbelt while operating a Geni model GTH-644 Rough-Terrain powered industrial truck, was exposed to being thrown, ejected from the equipment. Among other methods, one feasible and acceptable method to correct the hazard, is to require and enforce the use of a seatbelt, as per the requirement in the Geni Model GTH- 644 Rough Terrain Operator's Manual which states on page 1-9: "Always wear the seat belt when operating the machine". ABATEMENT CERTIFICATION AND DOCUMENTATION IS NOT REQUIRED
