P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a single wall 273-gallon diesel tank that was not guarded or protected from vehicular traffic, thus exposing employees to fire and struck-by hazard in the event of a boiling liquid expanded vapor explosion (BLEVE). a)Outside diesel refueling area-On or about July 25, 2011 and at times prior to, the employer failed to provide impact protection from vehicular traffic for a portable 273-gallon single wall diesel tank, thus exposing employees to struck-by and fire hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: 1.Install barriers between vehicular traffic and the storage tank, where exposure to hazard will be eliminated according to OSHA and NFPA requirements or relocate to an area away from vehicle traffic. ABATEMENT CERTIFICATION REQUIRED.
