P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard(s) of being struck-by vehicles:
a.At the site, on or about August 19, 2011, an employee working near the
roadway
was exposed to struck-by hazards from passing vehicles.
FEASIBLE MEANS OF ABATEMENT:
A feasible and acceptable means of abatement is to ensure all employees
are provided
with reflective high visibility vest or clothing and have been instructed
to utilize it while
working within areas near roadways.
ABATEMENT CERTIFICATION IS REQUIRED.TION
