P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of being ejected from the operator's compartment and being crushed by a forklift: a)In the shipping and receiving area, on or about August 17, 2011 and at times prior to, employees did not wear a seatbelt while operating the forklift, resulting in a crush-by hazard. ABATEMENT CERTIFICATION IS REQUIRED. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that employees wear a seatbelt while operating a powered industrial truck, as required by ANSI B56.1.ed
