P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of being struck-by vehicular traffic: a)In the intersection of Hwy 319 and Hwy 82, on or about November 17, 2011, Employee was exposed to being struck by vehicles while blowing leaf debris from the curb while walking in the traffic lane. Among other methods, one feasible and acceptable means of abatement is to ensure that all employees are provided with reflective high visibility vest or clothing and have been instructed to utilize the garment while working within areas near roadways. ABATEMENT CERTIFICATION IS REQUIREDATION
