P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, in that the employees were elevated and required to work from unapproved work platforms that were not designed and used in accordance with ANSI/ITSDF B56.1, thus exposing employees to fall hazard up to 11 feet. feet. a)Tire shop, on or about and at times prior to March 7, 2012, employees were allowed to retrieve and place tires in the metal rack system while being elevated from an unapproved work platform that was not designed in accordance with ANSI/ITSDF B56.1. The unapproved work platform was supported and elevated by a Caterpillar GP40 forklift, S/N 1CM02870, and was missing guardrails, toe boards, and anchor points, thus exposing employees to a fall hazard up to about 11 feet. b)Body shop, on or about and at times prior to March 7, 2012, employees were allowed to work from an unapproved work platform that was not designed in accordance with ANSI/ITSDF B56.1. The unapproved work platform was supported and elevated by an orange battery powered high lift hand truck, thus exposing employees to a fall hazard up to 7 feet. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS AS FOLLOWS: 1.With the approval of forklift manufacture, and the purchase of a proper safety work platform meeting the specifications of American National Institute Standard/Industrial Truck Standards Development Foundation (ANSI/ITSDF) B56.1-2009 or update to be used as required by paragraph 4.17, Elevating Personnel and 7.37, Platform Elevating. ABATEMENT CERTIFICATION IS REQUIRED
