Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the facility, on or about February 23, 2010 and prior thereto employees were observed operating a forklift without using the seatbelt. Employees were exposed to the hazard of being struck by the falling object protective structure (FOPS) and/or other parts of the forklift while being allowed to drive them without the use of the seatbelt. Among other methods, the following are feasible and acceptable methods to minimize the probability of injury during forklift operation throughout the facility is to establish a policy that: (a) requires the use of seatbelts, (b) requires communication of it toe employees, and (c) enforces the use of the seatbelts.
