Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by falling vehicle: a) In the shop of Valu Muffler for employees working around and under the Bend Pac Full Rise Scissor Lift, the safety locks were inoperable. Employees were exposed to a struck-by hazard. a) Among other ,feasible and acceptable abatement methods to correct this include, but not limited to the following: 1) Repair lift, 2) Develop and implement standard operating procedures for lift which includes daily and periodic inspection and a preventative maintenance program in accordance with manufacture specifications as outlined in ANSI B153.1 and ANSI/ALI 2000 Safety Requirement for Installation and Service Standard. 3) Instruct all employees on the safe operating procedures of the lift, including but not limited to the operation, maintenance, daily and periodic inspection. ABATEMENT CERTIFICATION REQUIREDATION
