Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries by not wearing a seat belt while he was operating a powered industrial truck: (a) Facility, Outside: On or about February 25, 2010, an employee was operating a Yale forklift and he did not have the seat belt secured around him. Among other methods, one feasible and acceptable means of abatement is to retrain this employee and ensure that all forklift operators wear their seat belt when operating a powered industrial truck (forklift).

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed injuries due to a lifting yoke that had not been rated: (a) Facility, Machine Shop: On or about February 25, 2010, employees were using a lifting yoke that was not marked with its capacity and no one knew its lifting capacity. (b) Facility, Machine Shop: On or about February 25, 2010, employees were using a lifting yoke that did not have frequent (monthly) inspections. (c) Facility, Machine Shop: On or about February 25, 2010, employees were using a lifting yoke that did not have periodic inspections. (d) Facility, Machine Shop: On or about February 25, 2010, there was no latch on the hook of the Vital 2 ton underhung hoist. (e) Facility, Machine Shop: On or about February 25, 2010, the 2 ton Vital underhung hoist did not have frequent (monthly) inspections. (f) Facility, Machine Shop: On or about February 25, 2010, the 2 ton Vital underhung hoist did not have periodic (annual) inspections. (g) Facility, Machine Shop: On or about February 25, 2010, the steel support system for the 2 ton Vital underhung hoist was only rated at 200 pounds maximum capacity. Among other methods one feasible and acceptable means of abatement is to perform inspections and maintenance procedures and operate the hoist in accordance with the requirements outlined in the American Society of Mechanical Engineers standard, ASME B30.16.
