Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized
hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck-by hazards:
(a) Railcar Unloading, Railcar Spur; On or before Friday, June 11, 2010,
employees were
exposed to struck-by hazards while working to unload materials from the
train cars. The
employer had not instituted a "blue flag" warning system to alert train
operators that employees
are working on or near train cars.
Among other methods, one feasible and acceptable means of abatement is to
institute a suitable
warning system (blue flag warning system) to be displayed at each
accessible end of the car or
depth to warn trainmen against making a coupling.  In addition, conduct
training sessions for
employees tasked with working on or near train cars.
